Terms of Use

These Terms of Use (“Terms”) govern your use of the ESIVA application (“ESIVA”, the “App”), the esiva.app website and related services provided by Nordic Labs Tech Oy (“we”, “us”, “our”).

ESIVA is currently in development. App-specific provisions below describe the intended public service and will be reviewed against the final release before ESIVA becomes publicly available.

If ESIVA is downloaded from the Apple App Store, the applicable Apple Standard End User License Agreement may also govern your license to the App. Where required, Apple's terms apply in addition to these Terms.

1. Use of ESIVA

ESIVA is intended for personal, non-commercial fitness and general wellness use.

You agree not to:

• misuse, disrupt or interfere with ESIVA or its services;
• attempt to reverse engineer, circumvent security controls or access functionality in an unauthorized way except where applicable law expressly permits it;
• use ESIVA for unlawful or fraudulent purposes;
• use ESIVA in a way that infringes the rights of Nordic Labs Tech Oy, other users or third parties.

2. Fitness, Nutrition and Wellness Disclaimer

ESIVA provides fitness, nutrition, recovery and general wellness guidance. Recommendations may be generated from information available to the App, including activity, training, recovery, nutrition and other context.

ESIVA is not a medical device and does not provide medical diagnosis, treatment or emergency services.

Recommendations are informational and do not replace advice from a qualified healthcare professional.

You remain responsible for deciding whether any workout, nutrition suggestion or other recommendation is appropriate for you.

Stop exercising and seek appropriate professional assistance if you experience symptoms or circumstances that make continuing unsafe.

3. Adaptive Recommendations

ESIVA is designed to adapt recommendations as new information becomes available. Training times, workout content, nutrition guidance, recovery guidance and other parts of a plan may therefore change during the day.

Recommendations are estimates and guidance, not guarantees of a particular fitness, health, weight or performance outcome.

4. Custom Workouts

ESIVA may allow you to select parameters such as target muscle groups, duration and available equipment to create a custom workout.

You are responsible for selecting appropriate exercises, loads, equipment and training conditions for your abilities and environment.

5. Nutrition Suggestions

ESIVA may provide meal timing, calorie, macronutrient or food suggestions for fitness and general wellness purposes.

Such suggestions are not medical nutrition therapy and are not intended to diagnose or treat allergies, eating disorders, metabolic disease or other medical conditions.

You are responsible for checking ingredients, allergens, dietary restrictions and whether a suggested food is appropriate for you.

6. Device and System Requirements

Some ESIVA features require compatible Apple devices, supported versions of iOS or watchOS and permissions to access relevant Apple system services.

Features that depend on Apple Health, Apple Watch sensors, network access or other platform services may be unavailable or less accurate when those services or permissions are unavailable.

7. Apple Health and Permissions

ESIVA may request access to selected Apple Health categories when that information is necessary for a feature you choose to use.

You control Apple Health permissions through Apple-provided settings and can revoke them at any time. Revoking a permission may limit features that depend on that information.

8. Subscriptions and Billing

ESIVA may offer paid functionality through Apple's In-App Purchase system. Final subscription options, pricing and trial availability will be shown in the App Store or App before purchase.

Automatic Renewal

Auto-renewable subscriptions, if offered, renew according to the terms presented by Apple unless cancelled through the user's Apple account within the applicable cancellation period.

Billing

App Store payments are processed by Apple. Nordic Labs Tech Oy does not receive your full payment-card details from Apple.

Managing and Cancelling

App Store subscriptions can be managed through the subscription settings associated with your Apple account. Deleting ESIVA does not by itself cancel an active App Store subscription.

Refunds

Refund requests for App Store purchases are handled under Apple's applicable refund policies.

9. Accounts and Service Features

The final public version of ESIVA may use Apple platform services or other service components to provide particular functionality. Any account requirements will be clearly disclosed before the relevant feature is used.

10. Intellectual Property

ESIVA, ARC Engine, software, visual identity, website content, product designs and related materials are owned by Nordic Labs Tech Oy or its licensors unless otherwise stated.

You may not copy, sell, redistribute or create unauthorized derivative works from protected ESIVA materials except as allowed by applicable law or applicable license terms.

11. Third-Party and Platform Services

ESIVA may rely on services supplied by Apple or other providers for platform functionality, infrastructure or specific product features. Availability of those services may affect ESIVA.

Where third-party processing is relevant to personal information, it will be described in the Privacy Policy applicable to the released version.

12. Availability and Changes

We may modify, improve, suspend or discontinue features as ESIVA develops. Screenshots, descriptions and pre-release materials may differ from the final product.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, ESIVA is provided on an “as is” and “as available” basis without guarantees that recommendations will be error-free, continuously available or suitable for every user or situation.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Nordic Labs Tech Oy is not liable for indirect, incidental or consequential losses arising from use of ESIVA.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any mandatory rights available to consumers under applicable law.

15. Termination

You may stop using ESIVA at any time. If you have an active subscription, it must be cancelled separately through the platform through which it was purchased.

We may suspend or discontinue ESIVA or particular services where reasonably necessary, subject to applicable law.

16. Changes to These Terms

We may update these Terms as ESIVA develops or as legal and operational requirements change. The current version and effective date will be published on this page.

17. Applicable Law and Consumer Rights

These Terms do not remove mandatory consumer rights that apply to you. Applicable governing-law and dispute provisions will operate subject to mandatory laws in the jurisdiction in which the service is offered.
